The terms behind FilenQ.

These Terms of Service ("Terms") govern your access to and use of the FilenQ website at filenq.app and the FilenQ application for macOS (together, the "Service"). By accessing the website or installing or using the app, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Service. These Terms form a binding agreement between you and the operator of FilenQ.

FilenQ is currently offered as early-access software. This means it is under active development, features may change, be added or be removed, and it may contain bugs or behave unexpectedly. Early-access builds are provided on an “as is” and “as available” basis.

We may modify, suspend or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension or discontinuation.

Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable licence to install and use FilenQ on Macs you own or control. This licence does not transfer any ownership of the software to you.

Except to the extent permitted by applicable law, you agree that you will not:

• Resell, rent, sublicense or redistribute the app or licence keys.
• Reverse engineer, decompile or disassemble the app, except where this restriction is prohibited by law.
• Remove or alter any proprietary notices, branding or labels.
• Use the app to build a competing product by copying its design or behaviour.

FilenQ includes power-user and security-related utilities. You are solely responsible for how you use them. Any inspection, network, hashing or security tooling included in the app is intended for use only on systems, files and networks that you own or are explicitly authorised to test.

You agree not to use the Service to:

• Break the law, infringe others’ rights, or access systems or data without authorisation.
• Process, store or distribute content you do not have the right to handle.
• Attempt to disrupt, attack or gain unauthorised access to any system or network.

Misuse of these tools is your responsibility. FilenQ is not liable for any consequences arising from unauthorised or unlawful use.

During early access, FilenQ is distributed through Gumroad on a pay-what-you-want basis: you may download it for free or contribute any amount. Contributions are voluntary, non-refundable, and are not required to download or use the app. A paid licence is planned after early access; final pricing has not been determined and may change before launch.

Purchases and contributions are processed by Gumroad, which acts as merchant of record and handles payment, invoicing and applicable taxes under its own terms.

Supporter recognition — including listings on the thank-you page, any dedicated supporter page, and any co-ownership or revenue-sharing arrangement — is discretionary, offered at our sole discretion, and arranged individually. A contribution alone does not automatically grant ownership, equity, or any other entitlement; any such arrangement is subject to a separate written agreement.

Refund eligibility for future paid licences will be described at the point of sale and is subject to Gumroad’s policies and your statutory consumer rights.

The FilenQ name, logo, website, app and all related content are owned by the operator of FilenQ and are protected by intellectual property laws. These Terms grant you no rights to use FilenQ trademarks or branding except as necessary to use the Service.

FilenQ is an independent product and is not affiliated with, endorsed by or sponsored by Apple Inc. macOS, Finder, Apple Silicon and related marks are trademarks of Apple Inc. Other product names are the property of their respective owners.

The Service relies on third-party services — in particular Gumroad, which handles distribution, downloads and payments. We do not control these services and are not responsible for their content, policies or practices. Your use of third-party services is governed by their own terms and privacy policies.

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free or secure, or that it will meet your requirements. You are responsible for maintaining your own backups of important files. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.

To the maximum extent permitted by law, FilenQ and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits or goodwill, arising out of or relating to your use of (or inability to use) the Service.

To the extent liability cannot be fully excluded, our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid (if any) for the Service in the twelve months preceding the event giving rise to the liability. These limitations do not affect liability that cannot be limited under applicable law.

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that could cause harm or legal liability. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles, and subject to any mandatory consumer-protection rules of your country of residence. Disputes will be subject to the competent courts of the Czech Republic, unless applicable law grants you the right to bring proceedings elsewhere.
